■ Article 1 (Purpose)
This Agreement sets forth the terms and conditions for the use of the information distribution service (defined in Article 2) provided by the non-profit organization
■ Article 2 (Definitions)
1. "ETIC." means the non-profit organization ETIC.
2. "Service" means various information distribution services provided by ETIC. via the Internet and e-mail.
3. "Each Email Delivery" means an individual email sent (delivered) by ETIC. to a user of the Service.
4. “User" means a person who has agreed to these Terms of Use and has completed the prescribed registration procedures.
5. “Personal Information" means information that can be used to identify individual Users.
■Article 3 (Users)
1. Users shall use the Service in accordance with the Terms of Use.
2. Users shall use any and all information obtained from the Service at their own discretion and responsibility.
3. In using the Service, Users shall not engage in any conduct that may cause inconvenience or disadvantage to third parties, interfere with the operation of the Service, or offend public order and morals.
4. Users may not reproduce, reprint, or otherwise use the information contained in each email distribution as the subject of similar activities without the permission of ETIC.
■Article 4 (Procedures for Changing Registered Information and Termination of Use)
1. If a user wishes to change his/her e-mail address or any other registered information, the user shall follow the procedures prescribed by the Service.
2. The user agrees in advance that the registered e-mail address, etc. will be used to send notifications regarding the Service.
3. Users may terminate their use of the Service in accordance with the prescribed procedures of the Service.
■Article 5 (Suspension and Revocation of Eligibility for Use)
ETIC. may, without prior notice, immediately suspend the use of the Service or revoke the eligibility for use of the Service for any User who falls under any of the following items
(1) When there is a false statement in the registration information
(2) Interferes with the operation of this service
(3) In the event of any other violation of these Terms and Conditions.
Even if ETIC. suspends or revokes a user's eligibility in accordance with the preceding paragraph, ETIC. shall not be liable to the user in question.
■Article 6 (Users' Personal Information)
1. ETIC. shall maintain personal information, such as names and e-mail addresses, provided by Users for the purposes set forth in the following paragraph under a strict control system, and shall make reasonable efforts to enhance security to prevent unauthorized access by third parties.
2. ETIC. shall use the personal information of users only for the purpose of providing the Service. When ETIC. uses personal information for any other purpose, ETIC. shall specify the purpose separately and obtain the consent of users.
3. ETIC. shall not disclose personal information to third parties without the consent of the user, except in the following cases
(1) When it is necessary to disclose personal information to a business partner for a purpose for which the User has given consent. In this case, ETIC. shall require the business partner company to strictly manage the personal information and shall not allow the business partner company to use the personal information for any purpose other than that for which the User has given consent.
(2) When ETIC. receives a request for disclosure of personal information from a judicial or administrative agency and is legally obligated to do so.
4. Users may inquire about, correct, or delete their own personal information provided to ETIC. through procedures separately stipulated by ETIC.
■Article 7 (Disclaimer)
1. We and our contractors shall not be liable for any damages of any kind arising from the use of various information obtained by the user for this e-mail magazine.
2. ETIC. does not guarantee the completeness, accuracy, certainty, usefulness, etc. of the contents, etc. of information distributed through this service.
3. ETIC shall not be liable for the provision, delay, modification, interruption, or discontinuation of the Service, leakage or loss of information provided through each e-mail distribution, or any other damages incurred by users in connection with the Service, except as expressly provided in these Terms of Use.
4. ETIC. shall not be held liable for any inability to use the Service due to reasons attributable to the User or a third party other than ETIC.
■Article 8 (Maintenance)
1. ETIC. may change the name, content, URL, etc. of the Service upon notice to the User when necessary for operation or other reasons.
2. ETIC. may suspend operation of the Service without prior notice to the User in order to maintain the Service in good working condition.
■Article 9 (Modification of these Terms and Conditions)
ETIC. reserves the right to change these Terms and Conditions at its discretion. In this case, ETIC. shall notify the User of the changed portions of these Terms of Use in a manner determined by ETIC. In such case, such changes shall be deemed approved by the User if the User does not terminate use of the Service in accordance with Article 4.3 within 7 days from the date of the notice regarding the changes to this Agreement.
■ Article 10 (Miscellaneous)
1. The laws of Japan shall apply to the formation, validity, performance, and interpretation of these Terms and Conditions.
2. In the event that any problem arises between the User and ETIC. in relation to the Service, the User and ETIC. shall consult with each other in good faith.
3. If the matter is not resolved through consultation, the courts of Japan shall have exclusive jurisdiction over the matter.
